Tax Foreclosure List will be posted:
1.The properties in the 2017 Foreclosure Sale will have a tax that is at least 3 full years delinquent (the full 2014 tax). In some cases earlier taxes may also be delinquent. The grace period is 3 full years. The full year 2014 taxes will be 3 years past due on May 1, 2017.
Note: It does not matter if the 2015, 2016 or 2017 taxes are paid. When one year’s tax is 3 years past due foreclosure begins.
2. We do not maintain a mailing list to notify people of each year's tax foreclosure. If you wish a list send a self-addressed stamped envelope requesting the list and it will be mailed after publication. The Summons and Notice, which includes a list of the properties, will be published in The Montesano Vidette (legal) section. The website will have a list after September 8, 2017.
3. We do not sell "tax certificates" or "deeds".
4. Qualified bidders: No person who is a county employee, officer or spouse of a county employee or officer may bid at this sale, nor may such person bid as an agent or allow any agent to bid on their behalf.If you obtain a list from us for research purposes, remember you will need to come into our office periodically to cross off those parcels that were paid since your list was printed or check them on the Grays Harbor County website at www.co.grays-harbor.wa.us. The list posted on the wall of the Treasurer's Office is updated periodically as payments are received. Parcels may be redeemed from foreclosure at any time up to and including the day before the auction.
5. RIGHT OF REDEMPTION: May be redeemed at any time before the close of business the day before the day of the sale EXCEPT, the real property of any minor person, or any person adjudicated to be legally incompetent may be redeemed at any time with three (3) years after the date of the sale. RCW 84.64.060 All properties are sold subject to the protections and provisions of the U.S. Service Members Civil Relief Act, (50 U.S.C. app § 501 et seg.)
6. As real estate taxes are in the first lien position, the tax foreclosure may extinguish all other encumbrances including but not limited to Deed of Trust, mortgages, contracts, liens, judgments and any similar items. However, any Local Improvement Assessments (LID's), Road Improvement Districts (RID's), Utility Local Improvement Districts (ULID's), etc, remain and become the obligation of the buyer. Also, Internal Revenue Service (IRS) liens remain.
7. Parcels are sold in the same order as they appear in the newspaper or in the list on the web page.
8. ALL SALES ARE FINAL. PROPERTIES ARE SOLD ON A "WHERE IS" AND "AS IS" BASIS.
Persons interested in any parcels should thoroughly research on their own all information regarding such parcels. This may include checking maps in the Assessor's Office and consulting public and private sources of information. Some real property information is available at the Grays Harbor County website www.co.grays-harbor.wa.us. An on-site inspection is also recommended. Just because the property looks desirable on the map does not mean it is. The map does not show the topography such as ravines, hills, slopes, etc., nor does the map show what is on the property (dense growth, swamp, boulders, etc.). Some properties may be accessed by private roads covered by easements for ingress and egress. Easements are not extinguished by the foreclosure sale but remain with the land. Similarly, when you see that a property lies near or under transmission line easements, there will likely be restrictions which should be researched. Easements may not appear on the Assessor's maps.

It is up to you to know exactly what you are bidding on. We cannot stress this too strongly. Every year people who have done little or no research or who do not know how to read a legal description buy properties that for him or her are totally useless. Knowledgeable parties who have done the proper research will avoid these properties. We do not overturn a sale and refund the purchase price because a bidder didn't know what they were bidding on, or because they didn't understand the legal description.
You are strongly encouraged to contact a private attorney if you have any questions regarding anything discovered in researching parcels.
9. Do not count on buying a house at the foreclosure auction. Normally, owners of improved properties subject to tax foreclosure will raise money to redeem the property before the sale, often at the last minute. Most houses with delinquent taxes also have a delinquent bank or other lender loans.
10. Properties not sold to the public at the auction are deeded to Grays Harbor County. These are called Tax Title Properties. Most of these parcels are of little value, which is why they didn't sell at the auction in the first place. Many of these properties are dangling strips, isolated triangles, undivided interests or mineral rights only. The former are usually narrow strips anywhere from a few inches to a few feet wide that were left over because of an error in a legal description, a survey or platting error, or an incorrect measurement. The triangles generally are created when a street or highway cuts through a lot leaving a small isolated triangle cut off from the rest of the lot or block.
THERE IS NO DEPARTMENT WITHIN THE COUNTY THAT HAS INFORMATION ON MORTGAGE COMPANY FORECLOSURES.
THE TAX FORECLOSURE AUCTION. The minimum bid includes what is owed on the tax, interest, penalties and foreclosure costs and some liens. The cost of preparing the deed, excise and recording fee are not included in the opening bid.
- To be an eligible bidder, registration is in person with a monetary deposit of $500.00 cashier’s check starting the Wednesday prior to the sale. An agent may act on your behalf, but MUST so note it on the registration form while signing in. Your deposit will be refunded if you are not a successful bidder the following work day after the sale.
- Bidding must be done in person, not by phone or mail. This is an open oral auction, not a sealed bid auction.
- A Tax Judgment Deed will be recorded within 30 days of the sale.
- Payment by the successful bidder must be made in full the day of the sale.
- If you are interested in any parcel that did not sell at the sale, you have up to (1) one year to be able to purchase that property for the starting bid over the counter in the Treasurer’s office
PAYMENT MUST BE MADE BY CASHIER'S CHECK PAYABLE TO THE GRAYS HARBOR COUNTY TREASURER, MONEY ORDER OR CASH. NO OTHER FORM OF PAYMENT WILL BE ACCEPTED INCLUDING PERSONAL CHECKS, BUSINESS CHECKS, CREDIT CARDS, OR LETTER OF CREDIT, ETC. THERE ARE NO EXCEPTIONS TO THIS POLICY.
Cashier Checks must be made payable to the Grays Harbor County Treasurer.
Most people bring a cashier's check for the maximum amount they are willing to spend, whether they intend to buy just one parcel or bid on several. If the cashier's check is for too much we refund the difference, but if it's not enough you will have to run to the bank for more money.
